Welcome to IncogChat ("we," "us," or "our"). By accessing or using incogchat.xyz (the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use IncogChat. By using the Service, you represent and warrant that you are 18 or older. We do not knowingly allow minors to use the platform. If we learn that a user is under 18, we will immediately terminate their access.

2. Description of Service

IncogChat provides a free, browser-based random video and text chat platform that connects users anonymously with strangers worldwide. The Service uses WebRTC peer-to-peer technology. No video or audio streams are stored on our servers.

3. Acceptable Use

You agree not to use IncogChat to:

  • Engage in, solicit, or promote any sexually explicit content involving minors (CSAM) — violations will be reported to relevant authorities immediately.
  • Harass, threaten, bully, stalk, or abuse any other user.
  • Share, broadcast, or distribute non-consensual intimate imagery (NCII).
  • Impersonate any person or entity.
  • Engage in any activity that violates local, national, or international law.
  • Use automated bots, crawlers, or scripts to access the Service.
  • Attempt to disrupt, hack, or reverse-engineer the Service or its infrastructure.
  • Transmit spam, malware, viruses, or any harmful content.
  • Record, screenshot, or otherwise capture another user's image or voice without their explicit consent.

4. Moderation & Reporting

We maintain active AI and human moderation. Users may be permanently banned for policy violations. If you encounter inappropriate behavior, use the in-app Report button. Reports are reviewed with a median response time of 8 minutes. We cooperate fully with law enforcement investigations.

5. Anonymity & No Account Required

IncogChat does not require you to create an account. However, we may collect technical identifiers (such as IP address or device fingerprint) for safety, moderation, and fraud prevention purposes, as described in our Privacy Policy.

6. Intellectual Property

All trademarks, logos, and content owned by IncogChat are our exclusive property. You may not copy, modify, reproduce, or distribute any part of the Service without our prior written consent. User-generated content transmitted through the Service remains yours; you grant us no rights to it (it is not stored by us).

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE CONTINUOUS, UNINTERRUPTED, OR ERROR-FREE ACCESS TO THE SERVICE.

We are not responsible for the conduct, content, or actions of any users you encounter on the platform. You use IncogChat at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCOGCHAT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

9. Third-Party Services

The Service may link to or integrate with third-party services (e.g., STUN/TURN servers for WebRTC). We are not responsible for the privacy practices or content of those third parties.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. Material changes will be announced on the Service with a revised "Last updated" date.

11. Termination

We reserve the right to suspend or permanently ban any user at our sole discretion, with or without notice, for any violation of these Terms or for any other reason we deem appropriate to maintain a safe platform.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or, where not permitted, in the courts of competent jurisdiction.
